Website Hosting Agreement

This contract is agreed upon at the time of application for the service(s) provided by Mid-Illini Communications to Client. By making an application for service to Mid-Illini Communications, whether by electronic or other means you agree to the terms of this contract, which is legally binding.

Terms and Conditions of Service

  • We do not allow Adult, Warez, illegal MP3 Sites or IRC Bots.
  • You may not store more data in your account than your allotted virtual server space.
  • Your virtual server (inc FTP and Telnet access) is for your personal use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people.
  • Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your virtual server.
  • You may not run server processes (e.g. talkers/IRC Bots) from your virtual server.
  • We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
  • When your account is closed, all files (including web pages, etc.) will be deleted.
  • We reserve the right to cancel your account at any time without notice.
  • We reserve the right to amend and update these Terms and Conditions at any time without notice.
  • Users must not participate in any form of un-solicited bulk e-mailing or spam.
  • By either applying for an account, logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.

Telnet Usage

  • Telnet shell accounts are made available for editing and setting up your web site. It is not a development platform for issues unrelated to your web site.
  • You must not leave your home directory at any time.
  • You must not attempt to gain the privileges of another user.
  • Interfering with the following files will result in your telnet access being removed - .bash_history - .bash_logout - .bash_profile - .bashrc.

Virtual Control Panel

  • Any attempt to use the Virtual Control Panel(tm) for purposes other than its intended use will result in your account being terminated.
  • Any attempt to obtain the source code and internal functionality of the Virtual Control Panel will result in legal action.

Payment Terms

  • Client agrees to supply appropriate payment for the services received from Mid-Illini Communications, in advance of the time period during which such services are provided.
  • Client agrees that all setup fees paid to Mid-Illini Communications are non-refundable once order has been placed.
  • Client is aware that if you are paying by credit card, prepayments will be billed and charged automatically, and that Mid-Illini Communications may apply the amount due to the provided card at any time.
  • All invoices, other than yearly renewal contracts, are normally sent to clients via e-mail. If invoices are required by postal mail for accounting purposes then a fee of $2.00 per invoice will apply.
  • Client understands and agrees that Mid-Illini Communications shall not be responsible for any charges or expenses that client may incur resulting from overdrawing client's bank account or exceeding client's credit card limit as a result of an automatic or manual charge generated by Mid-Illini Communications pursuant to this authority.
  • Returned checks will incur an administrative fee of $25.00.
  • Timely payment is crucial. All accounts that are past due by more than 5 calendar days are subject to 10% late Fee, with a minimum charge of $5.00, and interruption of service(s) without further notice. With all disconnections, a $30.00 reinstatement fee will apply to reactivate the service(s) again.
    If client's account is in default and their account is sent to collections, client will be responsible for any collections fees that may apply.
  • Mid-Illini Communications reserves the right to cancel service(s) at any time. All fees paid in advance of cancellation will be pro-rated and refunded by Mid-Illini Communications to client if Mid-Illini Communications initiates its right of cancellation and client is NOT in violation of these Terms and Conditions. If cancellation is caused by clients and/or its Client's breach of the Terms and conditions, then client agrees that no refund is due.
  • Due to protection concerns, all account cancellations must be done in writing via postal mail, or fax. Notifications of cancellation via letter or fax must include the company letterhead, account name, principal contact name with valid signature, last four digits of credit card number on file and reason for cancellation. Third party cancellations are not accepted. Client agrees to provide 30 working days notice of cancellation.
  • In the case of Client being provided with their own personalized virtual name servers, Client is responsible for deleting any host registrations from domain registrars within 5 working days of cancellation of service by either Client or Mid-Illini Communications. Client further agrees to pay Mid-Illini Communications all reasonable administrative costs if Mid-Illini Communications must intervene in deregistering the hosts.

Bandwidth Usage

  • If your bandwidth reaches the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage.
  • Each virtual server includes a nominated amount of bandwidth, if you use more than this amount then you agree to pay for this bandwidth at the rate stated for that particular package.

Web Page Content

  • Commercial use of web and ftp space is permitted.
  • You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate US law.
  • You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).
  • We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. Mid-Illini Communications does not allow adult, warez or illegal MP3 web sites on their servers.
